By using this website or hiring us to perform work, you agree to these terms. If you do not agree, please do not use this website or engage our services.
By accessing this website, requesting an estimate, or entering into a service agreement with Tracy Epoxy Flooring & Concrete Polishing, you confirm that you are at least 18 years of age, that you have the legal authority to enter into a binding agreement, and that you agree to be bound by these Terms and Conditions and our Privacy Policy, which is incorporated here by reference.
Tracy Epoxy Flooring & Concrete Polishing is a state-licensed and fully insured concrete flooring contractor based in Tracy, CA. We provide concrete flooring services including, but not limited to, epoxy floor coatings, polished concrete, stained concrete, polyaspartic coatings, concrete resurfacing, concrete grinding, pool deck coatings, and related surface preparation work.
All services are subject to an on-site assessment and a written agreement prior to work beginning. We reserve the right to decline any project that we determine is outside the scope of our capabilities or inconsistent with safe and professional standards of practice.
Estimates provided by Tracy Epoxy Flooring & Concrete Polishing are based on the visible and reported condition of the surface at the time of assessment. They are not final quotes until confirmed in a written agreement signed by both parties.
If conditions are discovered during the course of work that materially affect the scope - such as hidden moisture, prior coatings, structural cracks, or contamination not visible at the time of estimate - we will notify you before proceeding with any work that changes the price. Additional charges will only be incurred with your explicit approval.
All prices are in U.S. dollars. We are not responsible for price changes resulting from material cost fluctuations between estimate and project start date if more than 30 days have elapsed.
Project start dates are confirmed in writing at the time of agreement. We will make every reasonable effort to begin and complete work within the agreed timeframe. Delays caused by weather, material availability, or conditions outside our control may require rescheduling, and we will notify you as soon as possible if this occurs.
Cancellations made at least 72 hours before a scheduled project start date will incur no cancellation fee. Cancellations made within 72 hours of the start date may be subject to a fee equal to any direct costs already incurred, such as materials ordered specifically for your project.
The client is responsible for ensuring the work area is fully cleared and accessible at the agreed start time. If the work area is not ready and the crew cannot begin, we reserve the right to reschedule and may charge a trip fee for the delay.
Payment terms are specified in your written project agreement. In general, we require a deposit prior to scheduling and the balance is due upon project completion unless otherwise agreed in writing.
Accepted payment methods will be specified in your agreement. Returned checks or declined payments may be subject to a processing fee.
Unpaid balances more than 30 days past due may accrue interest at the maximum rate permitted by California law and may result in the project being placed with a collections agency. The client agrees to reimburse Tracy Epoxy Flooring & Concrete Polishing for any reasonable costs of collection, including attorney fees, to the extent permitted by applicable law.
The client is responsible for the following prior to and during the project:
Failure to meet these responsibilities may affect the outcome of the work and may affect the validity of any warranty provided.
Where a warranty is provided, its specific terms, duration, and coverage will be stated in your written project agreement. Warranty coverage is contingent on proper client care of the finished surface as described in the post-installation instructions we provide.
Warranty coverage does not apply to damage caused by improper use, abuse, neglect, modification of the surface by a third party, structural movement of the substrate beyond normal conditions, or failure to follow our care instructions.
If no warranty is specified in your written agreement, services are provided "as is" consistent with industry standards for the type of work performed.
To the fullest extent permitted by California law, Tracy Epoxy Flooring & Concrete Polishing will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to our services or your use of this website, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising from services rendered is limited to the amount you paid us for the specific project that gave rise to the claim.
This website and all content on it are provided "as is" without any warranty of any kind, express or implied. We do not warrant that the website will be available at all times, free from errors, or free from viruses or other harmful components. We reserve the right to modify, suspend, or discontinue any part of the website at any time without notice.
If a dispute arises between you and Tracy Epoxy Flooring & Concrete Polishing related to services or these Terms, we ask that you contact us first to try to resolve the matter directly. Most concerns can be addressed quickly when both sides communicate openly.
If a dispute cannot be resolved informally, the parties agree to attempt mediation in Tracy, CA before initiating formal legal proceedings. If mediation fails, any legal action must be brought in the courts of California, and both parties consent to the exclusive jurisdiction of those courts.
Nothing in this section prevents either party from seeking emergency injunctive relief where appropriate.
These Terms and Conditions are governed by the laws of the State of California, without regard to its conflict of law provisions. Any claim or dispute not resolved through mediation will be subject to the exclusive jurisdiction of the state and federal courts located in California.
We reserve the right to update or modify these Terms and Conditions at any time. Changes will be posted on this page with an updated effective date. Your continued use of this website or engagement of our services after changes are posted constitutes your acceptance of the revised terms. We encourage you to review this page periodically.
